Terms & Refund Policy

These terms govern your use of Anaesthesia Viva (the “Service”), a private study site operated by Dr Adrian Langley. By registering for or using the Service you agree to these terms. If you do not agree, do not use the Service.

1. What the Service is

The Service provides curated practice material for anaesthesia examinations — vivas, short-answer questions, landmark-trial summaries and MCQs, with model answers. It is a study aid only. It is not clinical advice, not a clinical guideline, and is not affiliated with, endorsed by, or connected to ANZCA, CICM, or any examining college or organisation. Question stems are drawn from publicly available college examination reports and are attributed to their sources.

2. Registration and approval

You must register with a valid email address and verify it. Access is granted at the administrator’s discretion following review of your registration. We may decline, suspend, or revoke access at any time, including where these terms or the fair-use rules are breached.

3. Membership, tokens and pricing

• Annual Access grants 12 months of access to the Service and includes 50 credits. When it expires, access pauses until you renew; your unused credits are retained and become usable again on renewal.
• Credits (tokens) are spent to permanently unlock the full model answer of an item. Browsing question stems, landmark trials and MCQs does not cost credits. A credit, once spent, permanently unlocks that item for you.
• Credits and memberships are personal to your account, are non-transferable, have no cash value, and cannot be exchanged for cash.
• Prices are shown at checkout in Australian dollars and may include applicable taxes. We may change prices for future purchases; changes do not affect purchases already made.

4. Payments

Payments are processed by Polar, which acts as the merchant of record and handles billing, tax and invoicing. Your payment card details are handled by Polar and are never seen or stored by us. Your purchase is also subject to Polar’s terms.

5. Refund policy

Because unlocking a model answer immediately delivers digital content, unlocked items are generally non-refundable. However, we want you to be treated fairly:

• If you purchased Annual Access or a credit pack and have not spent any of the associated credits, you may request a full refund within 14 days of purchase.
• If something has gone wrong — you were charged in error, the Service was unavailable, or credits were not delivered — contact us and we will make it right.
• To request a refund, email crit.care.qld@gmail.com from your account email with your order details. Approved refunds are returned via Polar to your original payment method.

Nothing in this policy limits any non-excludable rights you may have under the Australian Consumer Law or other applicable consumer protection law.

6. Acceptable use

• The Service is for your personal exam preparation only.
• You may not scrape, bulk-download, copy, resell, or redistribute the content, or share your account. Downloading more than 30 items in an hour triggers an automatic 24-hour suspension; abuse may lead to permanent removal without refund.
• You may not attempt to bypass the authentication, token, or rate-limit controls.

7. Intellectual property

The compiled content, model answers and site are the property of the operator. Source examination reports remain the property of their respective colleges and are used for educational commentary with attribution.

8. Disclaimer and limitation of liability

The Service is provided “as is”, without warranty of any kind. Model answers are prepared for study and may contain errors; they must not be relied upon for clinical decisions — always verify against current primary sources and local guidelines. To the maximum extent permitted by law, the operator is not liable for any loss arising from use of the Service, examination outcomes, or reliance on its content.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms. Provisions that by their nature should survive termination (payment, IP, disclaimers, liability) will survive.

10. Governing law

These terms are governed by the laws of Australia. We may update these terms from time to time; the “last updated” date above reflects the current version.
